GENERAL ACQUISITION OF TURKISH CITIZENSHIP


Acquisition and loss of Turkish citizenship and related issues are regulated within Turkish Citizenship Law numbered 5901 (hereinafter "the Law") and the Regulation on the Implementation of Turkish Citizenship Law "the Regulation". According to the Law, Turkish citizenship can be acquired either by birth or by an application after birth. It should be noted that acquisition of Turkish citizenship after birth is also possible in some different ways but this article will only cover the general acquisition of Turkish citizenship as it's stipulated in Article 10 of the Law and Article 14/1-a of the Regulation.

 

The conditions that shall be met by foreign persons for the application for the general acquisition of Turkish citizenship are stated within Article 11 of the Law and Article 15 of the Regulation. In this regard, the mentioned conditions which shall be met by foreign persons who want to acquire Turkish citizenship are as follows;

 

be in the age of majority and have the capacity to act either according to his/her national law or, if he/she is stateless, according to Turkish law,
have been resident in Turkey without interruption for five years preceding the date of his/her application,
verify his/her determination to settle down in Turkey with his/her manners,
have no disease constituting an obstacle in respect of public health,
be of good moral character,
be able to speak a sufficient level of Turkish,
have income or profession to provide for maintenance for himself/herself and his/her dependants in Turkey,
have no quality constituting an obstacle in respect of national security and public order.

 

According to Article 16 of the Regulation, the application authority for the general acquisition of Turkish citizenship is the governorates where the settlement is located. Besides, while making an application, the applicant shall provide the documents that are mentioned in Article 17 of the Regulation.

 

After the submission of the application, according to Article 16 of the Regulation, the application authority makes a pre-examination about the foreigner who wants to acquire Turkish citizenship. This pre-examination is conducted to check whether the foreigner meets the conditions stipulated in the said Article. If the foreigner does not meet the conditions, the application is not accepted and this issue is notified to the foreigner in writing.

 

It should be stated that -according to Article 11 of the Law and Article 15 of the Regulation- foreign citizens who want to acquire Turkish citizenship may be asked to leave the state citizenship/citizenships they have. Moreover, it must be noted that having the required conditions, that are outlined above, does not give the person an absolute right to acquire citizenship.
